General Terms and Conditions ("GTC")

§ 1. Validity of the GTC
Powerlab AG, as the operator of this webshop, provides all deliveries and services on the basis of the following GTC in the version valid at the time of the order. Any deviating provisions must be made in writing. By sending the order, the customer acknowledges the GTC.

Swiss law shall apply exclusively. Should any provision of these GTC be invalid or should there be a loophole, this shall not affect the legal validity of the remaining provisions. In place of the invalid provision(s), a valid provision shall be deemed to have been agreed from the outset which comes as close as possible to the economic intentions of the parties. The same applies in the event of a loophole.

§2 Offer and conclusion of contract
Our price lists, brochures and publications on the Internet are generally non-binding. Your order constitutes an offer to us to conclude a purchase contract. When you place an order, we will send you an e-mail confirming receipt of your order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded when we dispatch the ordered product to you and confirm the dispatch to you with a second e-mail (dispatch confirmation). No purchase contract is concluded for products from the same order that are not listed in the shipping confirmation.

§ 3 Delivery and deadlines
The goods are delivered exclusively to all postal addresses in Switzerland.
Shipping fees according to the information on shipping. Powerlab AG is entitled to deliver orders in full, i.e. to wait with the dispatch of the goods until all items are in stock. Powerlab AG is entitled, but not obliged, to make partial deliveries. The additional shipping costs incurred will be borne by Powerlab AG. Powerlab AG is entitled to combine several orders from the same customer and send them in one delivery.

In the case of pick-up shipping, Powerlab AG will inform the customer as soon as the delivery is ready for pick-up. Collection during regular opening hours in Uster.

The customer is obliged to accept and pay for the goods. Delivery usually takes place within 1 day to 2 weeks. In the event of delivery bottlenecks, the customer will be informed and then has the right to withdraw from the contract in writing within 10 days of receipt of the notification. The deadlines will be postponed appropriately if obstacles arise that are beyond the control of Powerlab AG and/or its suppliers (force majeure, significant operational disruptions, strikes, late or faulty deliveries, etc.). ).

If the actual delivery time deviates significantly from the delivery time stated in the webshop, the customer may:

(1) waive further deliveries, which he must inform Powerlab AG immediately in writing.

(2) set Powerlab AG a reasonable deadline for subsequent fulfillment: If Powerlab AG does not fulfill within this period, the customer may, provided he immediately notifies Powerlab AG in writing, waive the subsequent performance or withdraw from the contract.

Powerlab AG will inform the customer as soon as possible about delays.

§ 4 Terms of payment
All prices are quoted in Swiss francs, including VAT, excluding any packaging and shipping costs.

In the case of payment by invoice, the customer undertakes to pay the purchase price upon receipt of the goods, at the latest upon receipt of the invoice. but to be paid within 10 days. Our bank / postal details can be found in the imprint or on the order confirmations.

Costs in the event of late payment: processing fee (at the earliest from day 70 after the invoice date, when handed over to the collection service provider) depending on the amount of the claim, maximum amount in CHF: 50 (up to 20); 70 (up to 50); 100 (up to 100); 120(up to 150); 149 (up to 250); 195 (up to 500); 308 (up to 1,500); 448 (up to 3,000); 1,100 (up to 10,000); 1,510 (up to 20,000); 2,658 (up to 50,000); 6% of the claim (from 50,000).

§ 5 Minimum order value
There is no minimum order value. However, a small quantity surcharge is levied for orders under CHF 59 that have to be shipped.

§ 6 Transfer of benefit and risk
Unless expressly agreed otherwise, benefit and risk are transferred from the sender to the customer upon dispatch of the goods.

§ 7 Warranty
The customer must inspect the goods delivered by Powerlab AG immediately upon receipt and notify Powerlab AG immediately in writing of any defects. If defects in delivered goods are documented by the customer, Powerlab AG will either remedy the defect or make a replacement delivery within a reasonable period of time. If Powerlab AG can neither remedy the defect nor deliver a corresponding replacement product within a reasonable period of time, the customer may withdraw from the contract or demand compensation for the reduced value.

Excluded from the warranty are defects and malfunctions for which we are not responsible, such as natural wear and tear, force majeure, improper handling, intervention by the customer or third parties, excessive use or extreme environmental influences.
If the customer resells the products, he is responsible for compliance with domestic and foreign export regulations. If the customer modifies the resold products, he shall be liable to us, the buyer or third parties for any resulting damage. The provisions of the Product Liability Act remain reserved.

§ 8 Returns
Unopened / unused goods can be returned to us within 14 days of receipt, stating the invoice number and reason for return, at the customer's own expense. Opened / used goods will not be taken back and will be invoiced in full. We reserve the right to refuse returns if the returned goods are not hygienically flawless.

Goods that have been sold at a reduced price due to shorter sales dates / shelf lives are excluded from return.
Goods that are sold at reduced prices and/or are classified as "clearance", "liquidation", "sale", "sale", "clearance" or "outlet" (e.g. from a previous season) are excluded from exchange. If this is disregarded, the resulting costs will be charged.

Returns that are made against our will or contrary to these General Terms and Conditions will result in additional costs. These will be charged by us and deducted from any refund.

§ 9 Exclusion of liability
Powerlab AG excludes any liability to the extent permitted by law.
No claims for damages can be derived from a delay in delivery.

§ 10 Use and intake of food supplements
The food supplements offered by Powerlab AG are not medicinal products. Product descriptions, recommendations for use and consumption and other content are for information purposes only and are taken from manufacturer information or specialist articles. They make no claim to completeness or correctness and are in no way a substitute for information and advice from a nutritionist or doctor. or pharmacist.

§ 11 Security and data protection
The protection of your privacy is of the utmost importance to us. We naturally comply with the statutory provisions on data protection.
You can request information about the data stored about you (scope, purpose) or request its deletion free of charge at any time. Your data will not be passed on to third parties.

§ 12 Place of jurisdiction
The place of jurisdiction is Uster. However, we may also call upon the court at the customer's domicile.
